Privacy notice

Stand: 19.10.2026

This is a translation provided for convenience. The German version is the legally binding one.

Protecting your personal data matters to us. Below we explain what data is collected when you visit this website, what we use it for, and what rights you have.

1. Controller

Landgasthof Fischer
Inhaber: Torsten Fischer
Walterstal 57, 09599 Freiberg / OT Kleinwaltersdorf
Phone: +49 (0) 3731 / 247812
Email: info@pension-fischer-freiberg.de

We have not appointed a data protection officer, as the legal requirements for doing so do not apply. If you have questions about data protection, please write to the address given above.

2. Hosting

This website is hosted by STRATO GmbH, Otto-Ostrowski-Straße 7, 10249 Berlin. Strato processes the data arising when the website is accessed on our behalf. The basis is a data processing agreement under Art. 28 GDPR. The legal basis is our legitimate interest in the secure and reliable operation of the website (Art. 6(1)(f) GDPR).

3. Server log files

Each time a page is called up, data is automatically stored in log files:

  • IP address of the requesting device
  • date and time of access
  • the file requested and the amount of data transferred
  • notification of successful retrieval
  • browser type and operating system
  • the page visited previously (referrer)

This data serves the technical provision of the site, system security and defence against attacks. The legal basis is Art. 6(1)(f) GDPR. The log files are deleted after seven days at the latest, unless there is a suspicion of a criminal offence.

4. Cookies and local storage

This website sets no advertising or tracking cookies of its own. The following are used:

  • Session cookie (PHPSESSID) – is only set when you open a form. It protects against misuse when sending (CSRF protection) and is deleted when the browser is closed. It is technically necessary; the legal basis is § 25(2)(2) TDDDG.
  • Local storage of your cookie choice – your choice in the consent banner is stored in your browser's storage so that we do not have to ask again on every visit. You can change this decision at any time via the “Cookie settings” link in the footer.
  • Guest account login cookie (lgf_gast) – only if you log in to your guest account; details under Guest account.

All other services (Google Maps, Google Analytics) are only loaded after you have explicitly agreed.

5. Contact and enquiry forms

You can send us messages through our forms (contact, room enquiry, celebration, catering). We process the information you enter – depending on the form, for example your name, address, email address, telephone number, travel dates and your message.

Purpose: Dealing with your enquiry and the related correspondence.
Legal basis: Art. 6(1)(b) GDPR where the enquiry is aimed at concluding or performing a contract, otherwise Art. 6(1)(f) GDPR (legitimate interest in answering enquiries).

Storage period: We store the enquiries until the matter concerned is settled and no further questions are expected. If a booking results, the related documents are subject to the commercial and tax retention periods of up to ten years (§ 147 AO, § 257 HGB). Earlier deletion is then not possible.

Spam protection: To ward off automated submissions we check whether a field invisible to people has been filled in and how much time passed between the form being opened and sent. We also limit the number of submissions per connection per hour. For this we store a hash of your IP address that cannot be reversed, for a maximum of two hours. The legal basis is Art. 6(1)(f) GDPR.

Email dispatch: The form contents are sent to our email mailbox, which is also hosted at STRATO GmbH. You additionally receive an automatic acknowledgement at the address you provided.

6. Online table reservation

Through our reservation page you can reserve a table in the Hofschänke or send an enquiry for a larger group. Reservations you make by telephone or in person are entered into the same system by our staff.

What is processed: Name, email address, your telephone number if you wish, date, time and number of people, as well as optional details such as high chairs, a dog and special requests. We also store when and by which route the reservation arrived (website, Google, telephone, telephone assistant) and what changes were made.

Purpose and legal basis: Carrying out your reservation, including confirmation, reminder, changes and cancellation, as well as our daily planning (Art. 6(1)(b) GDPR).

Special requests: This field is optional. If you tell us about intolerances or health needs, we process that information solely for your visit, on the basis of your explicit consent (Art. 9(2)(a) GDPR), which you give by entering it and can withdraw at any time. We delete the text the day after your visit.

Emails: You receive a confirmation, a reminder about 90 minutes before you arrive and a message if anything changes or is cancelled. The emails contain a personal link through which you can view, change or cancel your reservation. The link is secured with a secret key – please do not pass it on. We do not send you advertising this way.

Storage period: We delete your name and contact details 60 days after the reserved date. All that remains are the date, time, number of people and booking route, with no link to you as a person – for our planning and statistics.

Technology and security: The reservation system runs entirely on our web space at STRATO GmbH with servers in Germany, encrypted via HTTPS. No third-party services are embedded on the reservation page. Only our staff, with personal password-protected access, can see the reservations. The same protective measures apply as for our forms (an invisible check field, a timing check, and a limit per connection using a hash of the IP address, which is deleted after two hours at the latest).

Guest account (optional)

You can create a guest account. We then store your name, email address and, if you wish, your telephone number, link your reservations to the account and pre-fill your details next time. There is no password: you log in via a link we send you by email. It is valid for 30 minutes and only once; only a hash that cannot be reversed is stored. The legal basis is Art. 6(1)(b) GDPR (the contract of use for the account).

To keep you logged in, we set the following cookie after login: lgf_gast (only for the reservation pages, 180 days, technically necessary under § 25(2)(2) TDDDG). It is deleted when you log out.

Storage period: Your reservations remain visible in the account for as long as it exists. An account that has not been confirmed by email within seven days is deleted automatically. If you do not use your account for two years, you will receive a notice and we will delete it 30 days later. You can delete your account yourself at any time; your reservations then remain and are subject to the periods stated above.

News and offers by email

Only if you explicitly tick the box in your guest account will we send you emails about news, events and offers from Landgasthof Fischer. Your consent only takes effect once you have confirmed your email address via the link in our confirmation email (double opt-in). As evidence we store the time and place of the consent. The legal basis is your consent (Art. 6(1)(a) GDPR, § 7(2)(2) UWG).

You can withdraw your consent at any time – via the “Unsubscribe from news” link in each of these emails, in your guest account, or with a short message to us. We send the emails ourselves from our mailbox at STRATO GmbH; we do not use an external newsletter service. We do not track whether or when you open the emails.

7. AI-assisted telephone assistant

To handle telephone enquiries we use the smart telephone assistant from STRATO GmbH, Berlin is used. It processes the content of the conversation on our behalf in order to record, pass on or answer your request. This involves automatic speech recognition, semantic analysis and, where applicable, artificially generated speech.

You are told at the start. The assistant tells you at the start of the conversation that you are speaking to an assistant. The content of the conversation may be recorded, transcribed or documented – this only happens if you have been informed accordingly and continue the conversation. You can hang up at any time to avoid processing, and you can ask to speak to a person at any time.

What is processed: What you say during the conversation, technical connection data (date, time, duration), information you volunteer such as your name or a callback number, and interaction data, for example about how the conversation went or where it broke off.

Purpose: Receiving and dealing with your request.
Legal bases: Art. 6(1)(b) GDPR (initiation or performance of a contract) and Art. 6(1)(f) GDPR (legitimate interest in efficient communication).

Sub-processors and transfer to the USA: Sub-processors are used for the technical implementation, in particular for hosting, speech recognition and semantic analysis. Personal data may also be transferred to the USA in the process. The basis is the adequacy decision under Art. 45 GDPR, where the providers are certified under the EU-U.S. Data Privacy Framework; otherwise the transfer takes place on the basis of standard contractual clauses under Art. 46(2)(c) GDPR with additional safeguards.

Improving speech recognition: To improve speech processing, pseudonymised data may be used for training purposes. Tracing this back to individual people is excluded or made considerably more difficult.

Storage period: At the provider, the data is stored only for as long as it is needed for the purposes named, and is then automatically deleted or anonymised. The note that the conversation produces at our end is treated like an enquiry through our forms: we keep it until the matter is settled and no further questions are expected. If a booking results, the commercial and tax retention periods of up to ten years apply (§ 147 AO, § 257 HGB).

Speaking via the website: On our pages you will find a button “Questions? Speak here”. Only when you click it, the voice widget is loaded – before that there is no connection to the provider whatsoever. Your browser then asks whether it may access your microphone; nothing is recorded without your explicit permission. During a conversation via the website, your IP address and technical details about your device are also transmitted to the provider and its sub-processors. The legal basis is your consent, given by that click (Art. 6(1)(a) GDPR). You can end the conversation at any time and reload the page.

Binding commitments: The assistant can accept and confirm reservations itself. What you can do about that is set out below under “Automated decision-making”.

If you would rather not: Write to us instead using the Contact form or by email. If you ask to speak to a person during the conversation, we will put you through – your request will not be treated any less well for it.

8. Newsletter preference

In the forms you can tick a box to say that you would like to hear about news. We note this wish together with your enquiry. The legal basis is your consent under Art. 6(1)(a) GDPR. You can withdraw it informally at any time, for example by email to info@pension-fischer-freiberg.de. The lawfulness of processing carried out before the withdrawal is not affected.

9. Online booking via CultBooking

For direct room bookings we use the CultBooking booking system. The button “Go to booking” takes you into the provider's booking process. Your data is then transferred directly to them, and your IP address is processed there.

The provider is
Cultuzz Digital Media GmbH
Ullsteinstraße 130, Tower B, 6th floor, 12109 Berlin
Phone: +49 30 726225-0, email: info@cultuzz.com

The provider states that it sets no cookies for the booking screen. The integration is based on Art. 6(1)(b) GDPR (initiation and performance of the accommodation contract) or Art. 6(1)(f) GDPR. If you would rather avoid this transfer, please book by telephone or through our enquiry form.

10. Google Maps

On the “Contact” page you can load a map from Google Maps. The map is only after your explicit agreement loaded – until then you only see a notice with buttons for route planning, which transfer no data to Google unless you click them.

When the map is loaded, your IP address and details about your browser are transmitted to Google, possibly also to servers in the USA. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. For transfers to the USA, Google relies on the EU-US Data Privacy Framework and on standard contractual clauses. The legal basis is your consent under Art. 6(1)(a) GDPR and § 25(1) TDDDG. You can withdraw it at any time via “Cookie settings” in the footer.

11. Google Analytics

This website uses Google Analytics 4, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Analytics helps us understand which pages are in demand so that we can improve what we offer.

Google Analytics is only loaded after your explicit consent. Cookies are set in the process and usage data – such as pages visited, time spent, approximate location, device type – is processed. We have activated IP anonymisation, so your IP address is shortened. Advertising features are switched off.

The legal basis is your consent under Art. 6(1)(a) GDPR and § 25(1) TDDDG. You can withdraw it at any time via “Cookie settings” in the footer. A transfer to the USA cannot be ruled out; Google relies on the EU-US Data Privacy Framework and standard contractual clauses. A data processing agreement is in place with Google.

12. Social networks

In the footer we link to our profiles on Instagram and Facebook. These are plain links, not embedded content. No data is transferred to the operators until you click one of these links. The provider of both services is Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Ireland.

13. Recipients of your data

Your data is passed on only where this is necessary to provide our services or where there is a legal obligation. Recipients are in particular:

  • STRATO GmbH (hosting and email mailbox)
  • Cultuzz Digital Media GmbH (booking system, only when direct booking is used)
  • STRATO GmbH, Berlin (telephone assistant, only during a call)
  • Google Ireland Limited (only with your consent)
  • Tax advisers and tax authorities, within the scope of statutory obligations

14. Your rights

You have the following rights in relation to your personal data:

  • Access about which data we process and for what purpose (Art. 15 GDPR)
  • Rectification of incorrect data (Art. 16 GDPR)
  • Erasure, unless a retention obligation prevents this (Art. 17 GDPR)
  • Restriction of processing (Art. 18 GDPR)
  • Data portability (Art. 20 GDPR)
  • Objection to processing based on legitimate interests (Art. 21 GDPR)
  • Withdrawal of consent given with effect for the future (Art. 7(3) GDPR)

An informal message is enough to exercise them: info@pension-fischer-freiberg.de.

15. Right to complain to a supervisory authority

You have the right to complain to a data protection supervisory authority. The authority responsible for us is:

The Saxon Commissioner for Data Protection and Transparency
Devrientstraße 5, 01067 Dresden
www.datenschutz.sachsen.de

16. Obligation to provide data

Providing your data is neither required by law nor by contract. Without the information marked as mandatory, however, we cannot deal with your enquiry. You can also reach us by phone at any time on +49 (0) 3731 / 247812.

17. Automated decision-making

Our telephone assistant can reserve tables in the Hofschänke on its own, without a person being involved. Insofar as this constitutes an automated decision within the meaning of Art. 22 GDPR, you can at any time ask for a person to review it, state your point of view and contest the decision. Call us or write to us to do so. No profiling takes place.

18. Changes to this notice

We adapt this privacy notice when what we offer or the legal situation changes. The version published here is the one that applies.
